Charging Orders

A Charging Order is an order from the court placed on a debtor's property (specifically their house or land) for monies owed to a lender.

If your customer has borrowed money and the repayment schedule has not been adhered to, a lender can ask the court to place a charging order on their property so that when it is sold, the solicitor handling your sale will have to repay that debt first before any of the proceeds are made available to you.

Before the courts will consider an application for a Charging Order, the lender is obliged to issue a county court judgement and your customer, the debtor, must have failed to make payments on that judgement or not paid the judgement at all, according to the requirements laid down by the court.
